International Family - UK Obligations

International Tax | Compliance

An internationally mobile family required advice on their ongoing UK tax obligations. The family had partially relocated overseas, with some family members becoming non-UK resident while others remained in the UK. They retained significant UK connections, including property, business interests, and family ties.

International families face a patchwork of tax obligations. The UK taxes individuals based on residence and, in some cases, domicile. Non-UK residents may still be taxable on UK source income and gains on UK residential property. And complex rules determine the treatment of income and gains arising through trusts and corporate structures.

Our advice covered:

Residence Status: We analysed the residence status of each family member under the statutory residence test, confirming who was UK resident and who was not. For non-UK residents, we advised on the ongoing day count limits to maintain non-residence status.

UK Source Income: Several family members continued to receive UK source income, including rent from UK property, dividends from UK companies, and interest from UK bank accounts. We advised on the tax treatment of this income and the mechanics of claiming double taxation relief where appropriate.

UK Residential Property: Non-UK resident family members owned UK residential property. We advised on the annual tax on enveloped dwellings (ATED) where applicable, non-resident capital gains tax on disposals, and the non-resident landlord scheme for rental income.

Trust Interests: The family had interests in trusts that held UK and non-UK assets. We advised on the UK tax treatment of distributions to UK resident and non-UK resident beneficiaries.

Compliance Framework: We established a compliance framework to ensure that all UK tax obligations were met. This included filing requirements for each family member, payment deadlines, and the information needed to prepare accurate returns.

Coordination with Overseas Advisers: We worked with the family's advisers in their countries of residence to ensure coordinated advice and to manage the risk of double taxation. This involved reviewing overseas tax returns to ensure consistency with UK filings.

We prepared a comprehensive compliance manual for the family office, setting out the UK tax obligations of each family member and the procedures to be followed.
